WHAT IS DIGITAL SIGNATURE & ITS USE (DSC) ?:
A Digital
Signature Certificate authenticates your identity electronically. It
also provides you with a high level of security for your online
transactions by ensuring absolute privacy of the information
exchanged using a digital certificate. You can use certificates to
encrypt information such that only the intended recipient can read
it. You can digitally sign information to assure the recipient that
it has not been changed in transit, and also verify your identity as
the sender of the message.
INCOME TAX
The income-tax portal has made it compulsory in e Filing of Income
Tax Return through DSC for Partnership Firm, Company including
Individual, HUF those who are liable to Tax Audit apart from that in
normal cases return filed without DSC may have chance of mismatching
or non filing of return due to Acknowledgement in ITR-V have to sent
to ITD-CPC, Bengaluru by ordinary post may not properly received.
COMPANY MATTERS
MCA 21 portal has made it compulsory for registering DSC in all the
cases including the following:
INCORPORATION OF COMPANY:
Obtaining DIN-1, DIN-2, DIN-3, DIN-4 /
Availability or change of name of company / Situation or change of
registered office of the company / Appointment or cessation of
directors / Appointment of Managing Director / Registration of an
existing company into a limited company / Information of Auditors to
the Registrar of Companies / Application & Declaration for
incorporation of company / Obtaining Certificate of Incorporation &
all other jobs related to the Registrar of Companies.
AFTER INCORPORATION OR IN CASE OF RUNNING COMPANY:
Filing of Annual
Return, Profit & Loss Account, Balance Sheet / Return of Allotment
of Shares or buy back of shares / Creation of charges / Appointment
or cessation of receiver of company / Conversion of Public Limited
Company into a Private Limited Company / Consolidation, Division,
Increase of Share Capital / Alteration of Memorandum of Association
& Articles of Association / Information of Auditors to the Registrar
of Companies & all other jobs related to the Registrar of Companies.
SALES TAX
Govt. of West Bengal has introduced DSC in e filing of VAT, CST &
Sales Tax Return including New Registration under the Acts
PROFESSION TAX
Govt. of West Bengal will shortly introduc DSC in e filing of
Profession Tax matters.
ESIC & PROVIDENT FUND
Govt. of India has introduced DSC in e filing of ESIC & Provident
Fund.
CENTRAL EXCISE & SERVICE TAX
Govt. of India has introduced DSC in e filing of Central Excise &
Service Tax.
E TENDERING & E PROCUREMENT
Indian Railways, Coal India, Indian Oil, IFFCO, DGS&D, CPWD,
Defence, NTPC and many more have introduced e-procurement,
e-tendering & e-filing etc require verifying the authenticity of the
person. A digital certificate can be presented electronically to
prove your identity or your right to access information or services
on the Internet. It is a set of codes that is unique only to the
person who is holding it. It can not be tampered with. Digital
Signature or Digital Certificate is equivalent of a hand written
signature authenticated the documents has been digitally signed.
Such certificate issued by us on behalf of Certifying Agency can be
used to create legally valid Digital Signatures.
TYPES OF CERTIFICATE (DSC) AND ITS PERIOD OF VALIDITY:
There are 3
types of certificates, having different security levels, namely:-
Class-1, Class-2, Class-3 and is normally valid for 1 or 2 years,
after which it can be renewed.
CLASS – 1: Certificate are appropriate for Digital Signatures,
encryption and electronic access control for non-commercial
transaction where proof of identity is not required.
CLASS – 2: Individual certificates are appropriate for Digital
Signatures, encryption and electronic access control in transactions
where proof of identity based on information in the validating
database is sufficient.
CLASS – 3: Certificates issued to organization are based on a
confirmation that the subscriber organization does in fact exit and
that the person submitting the certificate application on behalf of
the subscriber was authorized to do so, these certificates are
appropriate to access control in transaction requiring a high
assurance about the subscriber’s identity.
DGFT: It is applicable in case of Import & Export only.
CAN THE DIGITAL CERTIFICATE SEEN? Yes, after the download is done,
one can open the internet explorer, go to tools and open the
Internet options. In the window, if one clicks the content, it will
show the certificate there. Upon clicking the certificate one can
see the details such as issued to, issued by, expiry date and name,
provided at the time of application. If one clicks this, the details
of the certificate would appear spelling out that ‘you have a
private key that corresponds to this certificate’. Whenever, the
digital signature is required to be affixed to the e-form, the same
will be picked up from this site and will be affixed to the e-form
but safe and proper method to keep DSC on e-token, a small USB port
devise, which is password protected can be plugged to USB port when
needed for digitally sign the documents otherwise to be kept in safe
custody when it will be not in use.
WHERE IS THE USE OF DIGITAL SIGNATURE CERTIFICATE: In our daily life
it is most useful to us. In filing of Income Tax Return, Sales Tax
Return, VAT Return, CST Return & in all cases of ROC matters it is
being widely used.
Apart from all above filing now the Digital Signature Certificate
also being used for E tendering, E procurement, E auction etc. in
various portals such as Indian Railways, Coal India, Indian Oil,
IFFCO, DGS&D, CPWD, Defence, NTPC and many more.
